1) Introduction
- Packhood operates a marketplace that lets Hosts list private storage space and Renters request to store goods in that space (each a “Booking”). Packhood is not a storage company, bailee, landlord, property broker, or insurer.
- By registering or using the Platform, you agree to be bound by these Terms and to pay all applicable fees. We may update these Terms prospectively at any time; your continued use means you accept the updated Terms.
- Services are only available to persons 18+. If you register on behalf of a business, you confirm you have authority to bind that entity.
2) Key Definitions
- Booking: month-to-month licence to use a Host’s storage space.
- Host: a user who lists and provides storage space.
- Renter: a user who pays to store goods.
- Price: the amount set by the Host for one month of use.
- Fee: the total payable by the Renter (Price + Packhood commissions/taxes).
- Commission: Packhood’s fee currently set at 20% (renter) and 5% (host) of the Price/Fee (may change prospectively).
- Start Date: 00:00 local time on day 1 of access.
- Storage Space: the physical space at the listing address.
- Prohibited Items: goods that may not be stored (see §9).
- Payment Manager: Packhood’s Stripe-based checkout and related tooling.
3) Accounts & General Obligations (All Users)
- Keep your account information accurate and secure; you are responsible for all activity. Notify us immediately of any suspected compromise.
- All payments and communications must remain on the Platform. Off-platform payment or solicitation is prohibited.
- You must comply with applicable law and these Terms at all times.
- We may monitor in-app messages to prevent fraud and enforce these Terms.
- We may suspend or terminate accounts or listings for breach, risk, fraud, or non-payment.
4) Bookings & Payment Flow (single PaymentIntent hold)
- When a Renter clicks Book Now, Packhood may verify identity via Stripe Identity. We place a temporary hold for the first month’s Fee using one PaymentIntent with manual capture.
- A Booking is not confirmed until the Host accepts.
- If the Host accepts within 48 hours, Packhood captures the hold; the Booking is confirmed and the Renter is charged.
- If the Host declines or doesn’t respond in 48 hours, the request expires and the hold is released.
- If the Host accepts after 48 hours, the original hold will have expired; the Renter must re-authorise payment.
- After Month 1, Packhood auto-bills monthly on the Start Date anchor until cancellation. Renters must keep a valid payment method on file and complete any SCA/3-D Secure. Failed or disputed payments may result in suspension or cancellation.
5) Fees, Payouts & Non-Circumvention
- The Renter pays the Fee; Packhood collects all amounts through the Payment Manager.
- Packhood deducts its Commission (currently 20% renter / 5% host) and applicable taxes/charges.
- Hosts are paid after each service month ends and after refunds/chargebacks/disputes for that period are resolved. We may require bank details and identity checks before disbursement.
- No off-platform payments. Attempting to bypass Packhood fees may lead to account removal, withholding of funds, and recovery of avoided commissions and costs.
6) Cancellations, Notice & Refunds
Renter cancels (before Start):
- ≥72 hours before Start → Full refund of month 1 (rent + Packhood fees).
- <72 hours before Start → 50% refund of month 1; remaining 50% retained by Packhood to cover reserved capacity. (Hosts are not paid before service is delivered.)
After Start (Host or Renter):
- Either party may end an active booking with 30-day notice layered after the current billing month.
- No refund for the current month; one additional notice month is billed.
- Effective End Date (EED) = current period end + 30 days, 23:59 local.
- All billing and payouts stop at EED.
Host cancels (before Start):
- Full refund to Renter. Repeat Host cancellations may reduce listing visibility or delay payouts.
No Host reply within 48h:
- Request expires; hold released; no charge.
Force majeure / verified safety:
Packhood may end immediately and issue a full or partial refund at our discretion, overriding the above rules.
Refund method:
- Back to the original card via Stripe; bank posting typically 5–10 business days.
- All times use the listing's local timezone.
7) Host Obligations
- Listings must be accurate, complete, and kept up to date (size, access, security, address, constraints).
- Provide safe, reasonable access as described; keep at least the same level of security you use for your own property at the premises.
- Ensure your listing complies with law, mortgage/lease terms, and insurance.
- Early Host cancellations without good reason may result in listing suppression or account action.
8) Renter Obligations
- Pay the Fee via Packhood and follow the booking rules.
- Use the space only for temporary storage; no alterations without Host consent.
- Package goods suitably for the conditions; keep the space tidy and free of waste.
- Remove all goods promptly when the Booking ends and return the space in the same condition, fair wear and tear excepted.
- You are responsible for damage you cause to the space or premises through negligence or misuse.
9) Prohibited Items (non-exhaustive)
You may not store: toxic/hazardous/contaminated goods; firearms/ammunition/explosives/fireworks; flammables (fuel, gas, solvents, paint); illegal goods/drugs/paraphernalia/stolen property; food/drink/perishables; anything alive (animals, plants, insects, fungus, bacteria); items emitting strong odours, gas, or leaking liquid; liquids of any kind; damp/mouldy/rotten/pest-infested goods; items generating heat/noise or likely to expand/burst; cash, securities, jewellery, high-value collectibles/art; or any item that would invalidate property insurance or is unlawful.
If Prohibited Items are found or there is misuse, Packhood may terminate the booking immediately with no refund and you may be liable for damages.
10) Disputes & Reviews
- Use in-app chat for access/condition issues. Keep communications on the Platform.
- Renter disputes (unsafe, inaccessible, materially not as described) should be raised within 48 hours of Start or incident, with photos/video.
- Host disputes (damage/misuse by Renter) must be raised within 48 hours of discovery and no later than 14 days after move-out, with time-stamped before/after photos and description.
- Packhood may request more information, contact both sides, inspect, suspend payouts, or involve authorities. Payouts are frozen during review.
- Packhood’s platform decision (refunds, credits, account actions) is final.
11) Host Goodwill Guarantee (Not Insurance)
- At Packhood’s sole discretion, we may reimburse a Host up to €300 per booking for direct physical damage caused by a Renter. This is goodwill only and not insurance.
- Eligibility: verified Host; accepted & paid Packhood booking; compliance with rules; pre-move-in time-stamped photos/video of the empty/clean space; reasonable security; timely claim per §10.
- Exclusions include: Prohibited Items; wear/tear; mould/humidity/pests; weather/ingress/acts of God; structural issues; consequential loss; mysterious disappearance; pre-existing damage; outside booking period.
- If Packhood pays, you assign to Packhood recovery rights against the Renter/third parties and agree to cooperate. Fraud or abuse voids eligibility and may trigger account action.
12) Privacy & Data
- We use Stripe for payments and Stripe Identity for KYC. We may require SCA/3-D Secure and additional verification.
- Our Privacy Policy explains how we process personal data. By using the Platform, you consent to such processing.
13) Content & IP
- You must have the rights to content you upload. You grant Packhood a worldwide, royalty-free, non-exclusive licence to host, display, adapt, and use such content for operating and promoting the Platform.
- Packhood’s trademarks, software, and site content are protected; you may not copy, extract, or reuse them except as permitted by law or with our written consent.
14) Acceptable Use
You must not upload or transmit content that is illegal, infringing, deceptive, harmful, or that could damage the Platform (malware, scraping, spam, etc.). We may remove listings or content and suspend accounts at our discretion.
15) Liability & Indemnity
- Packhood provides the Platform “as is” and disclaims implied warranties to the maximum extent permitted by law.
- You rely on other users’ information at your own risk. Packhood does not control the condition, safety, or legality of spaces.
- Cap: To the maximum extent permitted by law, Packhood’s total liability arising out of or related to a booking is capped at the total commissions Packhood received for that booking.
- You agree to indemnify Packhood for losses, costs, and expenses arising from your breach of these Terms, unlawful storage, or misuse.
16) Term, Suspension & Termination
- While you have active bookings, your account must remain active.
- We may suspend or terminate your account, bookings, or payouts for breach, fraud, risk, or non-payment.
- We may modify or discontinue features at any time (prospectively). Updates to these Terms take effect when posted.
17) Cookies
We use cookies to operate the site and understand usage (e.g., which pages are most popular). You can control cookies via your browser; some features may not work without them. See our Privacy Policy for details.
18) Governing Law & Venue
These Terms are governed by the laws of Ireland. The courts of Ireland have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Platform.
19) Miscellaneous
- Entire Agreement: These Terms (plus policies referenced here, including Booking Terms and Privacy Policy) are the entire agreement between you and Packhood.
- No Agency: Nothing here creates a partnership, joint venture, or agency.
- No Waiver: Failure to enforce a term is not a waiver.
- Assignment: You may not assign or transfer your rights without our consent; we may assign to an affiliate or acquirer.
- Severability: If any provision is unenforceable, the remainder stays in effect.
- Notices: We may notify you via email, in-app, or on the site.
